available there. The Site, our services, and content are referred to collectively as the “Services” for the  convenience of reading these Terms. You consent to being bound by these Terms by using our Services. 

If you do not agree to be bound by these Terms, do not use the Services. 

The Terms may be updated at any time by us. If we do, we’ll notify you by publishing the revised Terms  on the Site or by sending you other communications. Every time we update them or you use the  Services, it’s crucial that you read the Terms again. You agree to be bound by the updated Terms if you  keep using the Services after we’ve posted them. You are no longer permitted to use the Services if you  do not agree to be bound by the updated Terms. Due to the fact that our services are constantly  changing, we reserve the right to modify or terminate all or a portion of the Services at any time,  without prior notice, and for any reason. 

Important: By accepting these terms, you consent to the individual, final and binding arbitration of all  disputes between you and us, unless you withdraw your consent to arbitration within 30 days or the  dispute is exempt from arbitration, as more fully described in the dispute resolution section below. Payments 

When you use our Services to make a purchase, you give us or our third-party payment processor  permission to charge your payment method for that purchase (plus any applicable taxes and other fees  that may be incurred by or in connection with it). You are in charge of providing a legitimate payment  method and paying all fees on time. At checkout, you must pay in the currency of your choice for all  costs, fees, taxes, and other charges. You will be required to enter standard billing information, such as  your name, billing address, and credit card details, when you begin a purchase transaction through the  Services. Before completing your transaction, you might also be asked for more details to confirm your  identity. The terms and conditions of the third-party payment processor you use to complete the  transaction are applicable to your payment. 

Customer Satisfaction 

Victor Mudhe is dedicated to giving its customers high-quality products. We have made every effort to  accurately represent our items through our Services. However, please be aware that style, color, size,  shape, and appearance changes occasionally. Review our return policy if you’re not happy with your  purchase. 

Promotions

If not specifically stated otherwise, promotional codes are only valid once per customer and cannot be  used in conjunction with any other discounts. 

Promotional codes and offers are not applicable to orders that have already been placed and are only  valid for the expressly stated period of time or while supplies last. 

At any time, we reserve the right to reject, halt, or cancel promotional offers. 

Content 

(a) Our Content 

Victor Mudhe owns all copyrights to the images, text, audio, and video clips that appear on the Site as  well as any and all related intellectual property rights and licenses (collectively, “Content”). 

All such Content is either our own, or we have a license to it. 

Victor Mudhe hereby grants you a limited, non-exclusive, non-transferable, non-sublicensable license to  access and view the Content solely in connection with your authorized use of the Services and solely for  your personal and non-commercial purposes. This license is subject to your compliance with these  Terms. 

(b) User Content 

Any text, graphics, images, works of authorship of any kind, or other materials that you post, generate,  make available, or otherwise make accessible through the Services, or that you share with other users or  recipients, are referred to as “User Content.” 

User Content may not only include feedback (defined below). 

By making any User Content accessible through the Services, you hereby grant Victor Mudhe a non exclusive, transferable, worldwide, royalty-free license, with the right to sublicense, to use, copy, modify,  create derivative works based on, distribute, publicly display, and publicly perform your User Content, in  whole or in part, in connection with the Services and Victor Mudhe’s (and its successors and affiliates’)  business, including without limitation for marketing (whether now known or hereafter devised). You  understand that Victor Mudhe is not obligated to utilize any of the rights granted in these Terms and we  do not guarantee any confidentiality with respect to any User Content you submit or upload. 

By submitting or uploading User Content through the Services, you agree not to make any claims based  on our alteration of the User Content or any pictures, videos, statements, or other works contained in  the User Content, unless such claims are expressly prohibited by law. 

Additionally, you agree to designate Victor Mudhe as your agent with regard to the User Content, giving  him the authority to sign and deliver any documents in your name and on your behalf in order to grant  us permission to use the User Content you are licensing however we see fit, to safeguard your rights in  

any derivative works made using your User Content, and to have the User Content removed from any  other website or platform. 

All of your User Content is entirely your responsibility.

You affirm and warrant that you are the sole owner of all of your User Content or that you possess all  necessary rights to grant us a license under these Terms to use your User Content. 

Additionally, you guarantee that neither your user content, nor its use or provision by you through the  services, nor its use by Victor Mudhe on or through the services will infringe, misappropriate, or violate a  third party’s intellectual property rights, rights of publicity, or privacy, or lead to a violation of any  applicable law or regulation. 

Any User Content of yours that is removed or deleted (or is not removed or deleted) is not our  responsibility or liability. 

(c) DMCA/Copyright Policy 

Victor Mudhe respects copyright law and expects its users to do the same. Victor Mudhe’s policy is to  terminate Account Holders who are suspected of repeatedly violating the rights of copyright holders  when the situation calls for it.

Use of the services 

We sincerely hope that everyone enjoys using the Services. 

Because of this, you promise not to do any of the following, or we may have to suspend or delete your  Account: 

Post, upload, publish, transmit or transmit any content that: 

(i) infringe, misappropriate or violate the patents, copyrights, trademarks, trade secrets, moral rights or  other intellectual property, publicity or privacy rights of any third party; (ii) violates any applicable law or  regulation or facilitates any conduct that violates any applicable law or regulation or gives rise to civil  liability; (iii) is fraudulent, false, misleading or deceptive; (iv) defamatory, obscene, indecent, vulgar or  offensive; (v) promotes discrimination, bigotry, racism, hatred, harassment, or harm against any  individual or group; (vi) is violent, threatening, or promotes violence or behavior that threatens any  person or entity; or (vii) promote any illegal or harmful activity or substance; 

Use, display, mirror, or frame the Services, or any part of the Services, Victor Mudhe’s name, any Victor  Mudhe trademark, logo, or other proprietary information, or the structure and design of any page or  form contained on a page, without our express written consent, unless expressly permitted by the  functionality of the Services; 

Try to use any engine, software, tool, agent, device, or mechanism (including spiders, robots, crawlers,  data mining tools, or similar) other than the software and/or search agents provided by Victor Mudhe or  other publicly accessible third-party web browsers to access or search the Services or Content, or  download Content from the Services;

Send any unwelcome or unauthorized advertising, solicitation, or promotional materials via email, junk  mail, spam, chain letters, or any other means; 

Use the Services or Content, or any portion thereof, in a way that is prohibited by these Terms, for profit,  or for the benefit of a third party; 

Attempting to breach network security or to interfere in any way with Victor Mudhe’s networks or the  Services, or attempting to use the Services to gain unauthorized access to any other computer system; 

The gathering or storing of any personally identifiable data from other Service users without their  express consent; 

Use a false identity or misrepresent your affiliation with any person or organization; Violate any applicable law or regulation; or 

Encourage or make it possible for any other person to do any of the aforementioned. 

Although we are not required to do so, we reserve the right to do so in order to operate the Services, to  ensure compliance with these Terms, and/or to comply with applicable law or other legal requirements.  We are also not required to review or edit any Content. 

At any time and without prior notice, we reserve the right, but we are under no obligation, to remove or  disable access to any Content, including, but not limited to, any Content that we, in our sole discretion,  find to be objectionable or in violation of these Terms. 

We reserve the right to look into any violations of these Terms or actions that have a negative impact on  the Services. We may also consult and cooperate with law enforcement authorities to prosecute users  who violate the law. 

Feedback 

We welcome comments, suggestions, and reviews of the goods you buy from us as well as feedback on  how we can make the Services better (“Feedback”). 

You can provide feedback by getting in touch with us or leaving a review for a specific product. 

You give us a non-exclusive, unrestricted, worldwide, perpetual, irrevocable, fully paid, royalty-free,  sublicensable, and transferable license under any and all intellectual property rights that you own or

Correction of site errors 

When you place an order, Victor Mudhe cannot guarantee that every item listed on the website will be  available. If an item is not available, you will be contacted as soon as possible by phone or email. The  data on the website might be inaccurate or contain typographical errors. Anytime without prior notice,  we reserve the right to update any information as we see fit. Please be aware that these mistakes could  affect availability, pricing, and product information. In these situations, we reserve the right to cancel any  orders that contain pricing mistakes or inaccuracies. We sincerely regret any inconvenience. 

Indemnity 

You consent to defend and hold harmless Victor Mudhe (and its officers, directors, agents, subsidiaries,  joint ventures, and employees) from any claim or demand, as well as losses, expenses, damages, and  costs, resulting from any violation of these Terms, your use of the Services, or any activity connected to  your Account (including negligent or wrongful conduct). 

Gift Cards 

Presently, only digital gift cards purchased through www.victormudhe.com can be redeemed. 

We disclaim all liability for gift cards bought from unauthorized resellers, and we reserve the right to  refuse, cancel, or hold gift cards and orders in the event of suspected fraud, cards that were  inadvertently issued with the wrong denomination, or other infringements on gift card policies. 

Third Party Links 

There is a chance that the Services will link to external websites or sources. 

We only offer these links as a convenience, and we take no responsibility for the information, goods, or  services found on or accessible through those websites, or for the resources or links that may be found  there. 

You acknowledge sole responsibility for your use of any third-party websites or resources and that you  do so at your own risk. 

Termination 

At any time and without prior notice, we may, in our sole discretion, terminate your use of the Services. By sending us an email, you can always restrict access to your Account.

The following sections will remain in effect upon any termination, discontinuation, or cancellation of the  Services or your Account: User Content, Payments, Feedback, Disclaimer of Warranty, Limitation of  Liability, Dispute Resolution, Governing Law, and General Terms. 

Disclaimer of Warranty 

You are given access to all of the site’s products, services, and content “as is” and without any warranties  or guarantees. 

We expressly disclaim any warranties of merchantability, fitness for a particular purpose, quiet  enjoyment, non-infringement, and any warranties arising from course of dealing or usage of trade,  without limiting the aforementioned. 

Limitation of Liability 

Any incidental, special, exemplary, or consequential damages, including lost profits, loss of data or  goodwill, service interruption, computer damage, or system failure, or the cost of substitute services,  arising out of or in connection with these terms or from the use of or inability to use the services,  whether based on warranty, contract, tort (including negligence), or any other legal theory, are expressly  disclaimed by Victor Mudhe and any other party involved in developing, producing, or delivering the  services. Some jurisdictions do not allow the exclusion or limitation of liability for consequential or  incidental damages, so the above limitation may not apply to you. 

The above-mentioned exclusions and damage caps are essential components of the agreement between  Victor Mudhe and you. 

Governing Law 

Without regard to its rules on conflicts of law, the laws of the the U.S. Government shall govern these  Terms and any related actions. 

General Terms 

Entire Agreement: These Terms supersede and replace any and all prior oral or written understandings or  agreements between you and Victor Mudhe regarding the Services and Content. These Terms represent  the entire and only understanding and agreement between you and Victor Mudhe regarding the Services  and Content. 

The other provisions of these Terms will still be in full force and effect if any provision of these Terms is  found to be invalid or unenforceable (by a court of competent jurisdiction or by an arbitrator selected in  accordance with the terms of the “Dispute Resolution” section above, but only if you timely withdraw  from arbitration by sending us an opt-out email in accordance with the terms stated above). 

By operation of law or otherwise, you are not permitted to assign or transfer these Terms without Victor  Mudhe’s prior written consent.

Without this consent, any attempt by you to assign or transfer these Terms will be void. These Terms may not be assigned or transferred by Victor Mudhe without consent. 

These Terms will bind and benefit the parties, their permitted successors, and assigns, subject to the  aforementioned. 

Notices: Victor Mudhe will notify you of any notices or other communications under these Terms,  including those regarding modifications, in one of the following ways: (i) by email; or (ii) by posting to the  Services. 

The date of receipt for emails sent as notices will be taken to be the day the email was sent.
